What is the Blayney Local Environmental Plan 2012?

Blayney Local Environmental Plan 2012 (BLEP2012) commenced on 23 November 2012.  BLEP2012 replaces the development controls in Blayney Local Environmental Plan 1998 (BLEP1998) except for two deferred areas in Zone 1(c) - Rural Small Holdings along Forest Reefs Road (west of Cowriga Creek) and Browns Creek Road.  Please speak to Council to determine which plan applies to your land.

Why is a Local Environmental Plan (LEP) Important?

A Local Environmental Plan (LEP) is the primary local planning instrument that sets a range of controls for development in Blayney Shire.  This includes, but is not limited to, zoning of land and permissible land uses, the minimum lot size for subdivision, heritage conservation, and key development controls to protect the environment, minimise land use conflicts, and promote sustainable development. 

The combination of Blayney Local Environmental Plan 1998 and Blayney Local Environmental Plan 2012 provides land use controls for ALL land in the Blayney Shire.  BLEP2012 has been prepared in accordance with Council's adopted Land Use Studies & Strategies.

Blayney Local Environmental Plan 1998 (BLEP1998) (Zone 1(c) Rural Small Holdings - Forest Reefs Rd and Browns Creek Rd ONLY)

Blayney Local Environmental Plan 1998 (BLEP1998) is the plan that applies to specific areas in Zone 1(c) - Rural Small Holdings along Forest Reefs Road (west of Cowriga Creek) and Browns Creek Road. For all other areas in the Shire the relevant plan is Blayney Local Environmental Plan 2012 (BLEP2012).

BLEP1998 is made up of the written instrument, persons seeking confirmation of the application of the provisions of the BLEP1998 to a particular area of land in the Shire should apply to Council for a planning certificate under the provisions of Section 149 of the Environmental Planning & Assessment Act.  BLEP1998 was gazetted on 24 April 1998 and is subject to amendment. .
